SpaceX Faces Allegations of Illegal Firing and Sexual Harassment

SpaceX, led by tech billionaire Elon Musk, is facing serious allegations as the U.S. National Labor Relations Board (NLRB) files a complaint against the defense contractor. The complaint accuses the company of unlawfully terminating eight employees who had written an open letter criticizing Musk and raising concerns about the workplace’s handling of sexual harassment. This article explores the details of the complaint, Musk’s response, and the broader implications for SpaceX.

According to a copy of the NLRB complaint obtained by CNBC, the eight former SpaceX employees engaged in concerted activities by drafting and distributing an open letter that highlighted their workplace concerns. In the letter, they expressed the belief that Musk’s behavior in the public sphere was often distracting and embarrassing. They also alleged that his controversial social media posts and alleged sexual misconduct contradicted SpaceX’s own policies.

The employees’ open letter came shortly after Business Insider reported an incident in which Musk was accused of propositioning and exposing himself to a flight attendant on one of SpaceX’s private jets in 2016. This incident resulted in a sexual harassment claim against Musk, eventually leading to a $250,000 settlement in 2018. Both Musk and SpaceX’s COO, Gwynne Shotwell, denied the allegations, with Musk referring to them as “wild accusations.”

Following the publication of the open letter, the NLRB investigation discovered that SpaceX management engaged in interrogating the authors and made coercive statements to them. Some of these statements even included an invitation for the employees to quit if they disagreed with Musk’s behavior. Based on this evidence, the NLRB concluded that SpaceX had unlawfully fired the employees in response to their protected speech.

Elon Musk has positioned himself as a free speech advocate or absolutist, but his actions have often contradicted this image. Despite embracing free speech as a principle, Musk’s companies have repeatedly attempted to silence individuals who criticized him or his businesses. Examples include the suspension of Twitter accounts that shared critical records or remarks about Musk, as well as legal actions against individuals like Travis Brown and Aaron Greenspan.

The terminated SpaceX employees have not remained silent in the face of their dismissal. In addition to the NLRB complaint, they have also filed a formal complaint with the California Civil Rights Department, alleging a failure to address sexual harassment within the company. The NLRB has now issued a consolidated complaint against SpaceX, and the regional office is actively seeking a settlement between the company and the former employees. If a settlement is not reached, a hearing will take place on March 5 in Los Angeles. However, it is important to note that the decision of the administrative law judge does not guarantee finality and can be appealed to the NLRB board and federal appeals court.

SpaceX finds itself embroiled in yet another legal battle, this time facing serious allegations of unlawful termination and mishandling of sexual harassment claims.
