Abortion bans have been a topic of intense debate and controversy in recent years. New research estimates, published online by JAMA Internal Medicine, reveal the alarming consequences of such bans on rape survivors. The research, conducted by the medical director at Planned Parenthood of Montana, sheds light on the distressing reality faced by women and girls who become pregnant as a result of rape in states that implemented abortion bans after the landmark decision of Roe v. Wade was overruled.
According to the research letter, an estimated 64,000 women and girls in 14 states became pregnant due to rape following the implementation of abortion bans. These figures represent an unimaginable tragedy, as these individuals were forced into parenthood against their will. Additionally, the study estimated that nearly 520,000 rapes were associated with these pregnancies, highlighting the widespread issue of sexual violence that persists in our society.
Most concerning is the fact that the majority of these states had no exceptions for terminating pregnancies resulting from rape. Texas, for example, topped the list with approximately 45% of the rape-related pregnancies occurring within the state. Furthermore, the research revealed that 91% of these pregnancies took place in states without rape exceptions. This lack of provisions for rape survivors demonstrates a failure to provide reasonable access to abortion for those who need it most.
The study also addressed the legal complications surrounding abortion access in certain states. While abortion is not outright banned in Wisconsin or North Dakota, the legal uncertainty in Wisconsin and the relocation of North Dakota’s only abortion clinic has significantly complicated the process. Consequently, even in states without complete bans, many survivors face significant hurdles in accessing the care they require.
The research findings crystallize the unsettling reality that rape survivors are left with limited options and inadequate support. The study suggests that “few (if any)” of these women and girls were able to obtain in-state abortions legally, pointing to the failure of rape exceptions to address the needs of survivors. It is distressing to contemplate the physical and emotional burden forced upon these individuals who are denied the option to terminate pregnancies resulting from heinous acts.
The Supreme Court’s decision in June 2022, overruling Roe v. Wade, has triggered a wave of abortion restrictions across various states. This repercussion has led to an increase in patients traveling across state lines for abortion care. The Guttmacher Institute reported that during the first half of 2023, almost one in five people seeking abortions had to travel to other states. These statistics underline the urgency of enshrining protections provided by Roe v. Wade into federal law.
President Joe Biden has recognized the need to expand reproductive rights and protect the right to choose. As part of his re-election bid, he has expressed his commitment to preserving the principles established in Roe v. Wade. However, it is crucial for individuals and lawmakers alike to advocate for meaningful change and support for survivors of rape. Every person deserves the ability to make decisions about their own bodies, especially in circumstances as traumatic as rape.

The research estimates paint a harrowing picture of the consequences faced by thousands of women and girls who were impregnated against their will.
