Norfolk Southern has recently reached an agreement to pay $310 million to settle charges stemming from a toxic train derailment that occurred in East Palestine, Ohio in February of 2023. This settlement marks a significant step towards addressing the environmental and community impacts of the incident.
The majority of the settlement, roughly $235 million, is designated to cover all past and future cleanup costs associated with the derailment. In addition to this, Norfolk Southern will also pay a $15 million civil penalty to resolve alleged violations of the Clean Water Act. The settlement was reached following a lawsuit filed by the EPA and the U.S. Department of Justice against the company for violating the Clean Water Act.
The derailment of a freight train carrying hazardous substances led to a days-long fire that resulted in the evacuation of local residents and contamination of soil and waterways. The settlement agreement requires Norfolk Southern to take measures to improve rail safety and provide health monitoring and mental health services for the surrounding communities. The company will also be contributing an estimated $7 million towards remediation projects to reduce pollution and enhance water quality in the region.
Alan Shaw, the president and CEO of Norfolk Southern, expressed satisfaction with the timely resolution of the investigations and emphasized the company’s commitment to safety in the rail industry. He stated that Norfolk Southern will continue to fulfill its promises and remain dedicated to the community’s well-being in the long term.
The EPA Administrator, Michael Regan, underscored the importance of holding companies accountable for environmental disasters and ensuring that communities affected by such incidents receive proper compensation and support. Norfolk Southern’s total costs related to the derailment are estimated to be around $1.7 billion, and the company had already set aside funds to cover the settlement amount. The entire cleanup effort is projected to conclude by November 2024, although this timeline may be subject to change based on evolving circumstances. This settlement with the EPA follows a recent agreement by Norfolk Southern to pay $600 million in a class-action lawsuit related to the same derailment incident.
